Terms of Use for the Eretz Hemdah Website

1. General

Welcome to the Eretz Hemdah website.

The website is operated by Eretz Hemdah – Institute for Advanced Jewish Studies, Jerusalem, a registered association, association no. 580120780, whose address is 2 Brurya Street, Jerusalem 9318405 (hereinafter: “Eretz Hemdah” or the “Association”).

Use of the website, its content, and the features offered through it is subject to these Terms of Use and the website Privacy Policy. Browsing the website or taking any action through it constitutes the user’s acceptance of these Terms. A user who does not agree to these Terms is requested not to use the website.

Users are advised to read these Terms of Use and the Privacy Policy carefully before using the website, particularly before submitting information, sending a question, making a donation, or purchasing books or publications.

2. Purpose of the Website

The website is intended to provide information about Eretz Hemdah and its activities, including:

• the activities of the Institute and the Beit Midrash;
• study programs and the training of rabbis and rabbinical judges (dayanim);
• articles, newsletters, books, and Torah content;
• halachic responsa and study materials;
• information about the Eretz Hemdah-Gazit Beit Din Network;
• the option for rabbis and dayanim in the Diaspora to submit questions;
• the option to donate to Eretz Hemdah’s activities;
• the option to purchase Eretz Hemdah books and publications;
• links to additional websites and services related to the Association’s activities;

Eretz Hemdah may update the structure of the website, the content published on it, and the features offered through it from time to time.

3. Website Content

The content on the website is intended to provide Torah, halachic, educational, and public information.

Unless expressly stated otherwise, general content published on the website does not constitute a personal halachic ruling, a legal advice, a tax advice, an individualized professional opinion, or a substitute for examining all the circumstances of a particular case.

Halachic responsa, articles, and rulings may be based on specific facts, circumstances, and information. They should not necessarily be applied to another case, even where the cases appear similar.

Eretz Hemdah makes efforts to publish accurate and up-to-date information on the website. Nevertheless, the website might contain errors, omissions, inaccuracies, or content that has not been updated.

In the event of any conflict between general information appearing on the website and an official document, personal notice, ruling, agreement, or instruction provided separately, the relevant official document or version shall prevail.

4. Submitting Questions to Rabbis and Dayanim

The website allows rabbis and dayanim in the Diaspora to submit halachic questions through designated forms.

A person submitting a question may do so in his or her own name or on behalf of another person, provided that the other person has consented or the submitter is authorized to act on that person’s behalf. Responsibility for obtaining the appropriate consent or authorization rests with the submitter.

Any response, if provided, will be based on the information included in the question. The submitter should provide information that is as accurate, complete, and relevant as possible. Changes in the facts or the provision of incomplete information may affect the response.

A response provided to another person or in relation to different circumstances should not be relied upon. A private response may not be presented as a general or official position of Eretz Hemdah unless authorization has been granted to do so.

Submitting a question does not guarantee that a response will be provided or that it will be provided within any particular period. Eretz Hemdah may request additional information, edit the wording of the question for purposes of handling it, or decline to answer a question that is not suitable for the scope of the service.

Eretz Hemdah may edit, process, and publish questions and answers, in whole or in part, on the website, in publications, in books, and through other content channels of the Association, after removing names and identifying details.

A publication may include, as applicable, the city and/or country from which the question was submitted, provided that, under the circumstances, such information would not reasonably identify the inquirer.

Submitting a question constitutes consent to the use and publication described above. A submitter who does not wish the question to be published should expressly state this when submitting the question.

The form should not be used to submit personal or sensitive information that is not required for handling the question, particularly unnecessary information about third parties that is not needed for the halachic inquiry.

5. The Eretz Hemdah-Gazit Beit Din Website

The website may include general information and links to the separate website of the Eretz Hemdah-Gazit Beit Din Network.

Opening a case file, filing a claim, submitting documents, or taking any other action in a proceeding before the Beit Din may be done through the website and designated channels of the Beit Din Network, in accordance with the terms, agreements, rules of procedure, and policies published on the Beit Din website.

Merely browsing the Eretz Hemdah website, reading information, or following a link to the Beit Din website does not initiate arbitration proceedings, constitute the opening of a case file, or obligate the Beit Din to accept any matter for consideration.

Use of the separate website of the Beit Din Network is subject to the Terms of Use and Privacy Policy published on that website.

6. Donations

The website enables donations to Eretz Hemdah’s activities through several donation channels.

When making a donation, the donor will be shown the entity receiving the donation, the payment method, and other relevant details.

6.1 Direct Donations to Eretz Hemdah

A donation transferred to Eretz Hemdah’s account is processed through the Pelecard payment-processing system.

A receipt for a donation received directly into Eretz Hemdah’s account will be issued by Eretz Hemdah in accordance with applicable law, the details provided by the donor, and the status of the transaction.

Eretz Hemdah holds approval for donations under Section 46 of the Israeli Income Tax Ordinance. Eligibility for a tax credit is subject to the approval remaining in force, applicable law, and the circumstances of the donation.

6.2 Donations Through Friends Associations

The website may enable donations through the following Friends associations:

• United States: American Friends of Eretz Hemdah Institutions
• United Kingdom: UK Friends of Eretz Hemdah
• Switzerland: Verein der Freunde von Eretz Hemdah

When a donation is transferred to one of the Friends associations outside Israel, the relevant Friends association is the entity receiving the donation and is responsible for issuing the donor’s receipt or confirmation, in accordance with the law applicable to it and its terms.

Recognition of a donation for tax purposes depends on the donor’s country, the entity that received the donation, and the local law. The publication of a donation option does not constitute a commitment that the donation will be recognized for tax purposes in any country.

Before making a donation, the donor should verify that the selected channel and recipient entity are appropriate for the donor’s needs.

6.3 Acceptance of Donations

Eretz Hemdah and the relevant Friends associations may decline to accept a donation, suspend its processing, or return it to the donor if required by law, at the request of a bank, payment-processing company, or competent authority, due to a concern regarding an error or unauthorized use of the payment method, or due to a technical, operational, or other difficulty in processing the donation.

Completing the donation form or attempting to make a payment does not obligate Eretz Hemdah or the relevant Friends association to accept the donation.

If a donation is returned, the refund will, where possible, be made through the payment method used for the donation and in accordance with applicable law, the payment-processing company’s terms, and the circumstances of the matter.

6.4 Inquiries, Corrections, or Cancellation of a Donation

A request to inquire about, correct, or cancel a donation should be sent as soon as possible to [email protected] and should include the donation details needed to locate the transaction.

Handling of the request will depend on the status of the transaction, the entity that received the donation, the payment-processing system, applicable law, and the terms presented when the donation was made.

Eretz Hemdah does not guarantee that a donation can be canceled or amended after it has been completed, but it will review the request in accordance with the circumstances and applicable law.

Where the donation was made through one of the Friends associations outside Israel, it may be necessary to contact the relevant association directly.

7. Purchase of Books and Publications

The website enables the purchase of Eretz Hemdah books and publications.

Payment for books and publications is payment for a purchase and does not constitute a donation to the Association.

A payment receipt or other appropriate confirmation will be issued for the purchase in accordance with applicable law and the transaction details. The purchase of a book or publication will not result in the issuance of a donation receipt qualifying for a tax credit under Section 46 of the Israeli Income Tax Ordinance.

7.1 Prices and Payment

The price of the book or publication, shipping costs, and any additional payment applicable to the order will be displayed to the customer before the purchase is completed.

Shipping fees are not included in the price of the book or publication unless expressly stated otherwise on the purchase page.

The payment method, method of delivery, and other material details relating to the order will be displayed on the relevant page of the website.

7.2 Order Confirmation and Stock Availability

Completion of an order is subject to payment authorization and the availability of the books or publications ordered.

Eretz Hemdah may decline to confirm an order or may cancel it in the event of insufficient stock, failure to authorize payment, an obvious error in the product details or price, a technical malfunction, a shipping restriction, or another impediment that prevents completion of the transaction.

If an order is canceled after payment has been made, the amount paid for the order will be refunded to the customer in accordance with the payment method and applicable law.

An automated acknowledgment that an order has been received does not necessarily constitute final confirmation that the product is in stock or that delivery can be completed.

7.3 Submission of Information

The customer must provide accurate, complete, and correct information, including a name, contact details, and shipping address.

Eretz Hemdah will not be responsible for a delay, non-delivery, delivery to an incorrect address, or additional expenses caused by the provision of incorrect, incomplete, or outdated information.

If the customer provides information on behalf of another person or asks for the order to be sent to another person, the customer must ensure that he or she is authorized to provide that person’s details and has obtained that person’s consent.

7.4 Shipping Within Israel

Books and publications will be shipped in accordance with the shipping options and prices displayed on the website when the order is placed.

Delivery times may change due to circumstances beyond Eretz Hemdah’s control, including delays by the shipping company or postal services, the security situation, high demand, or unforeseen events.

7.5 International Shipping

Customers may request international shipping of books and publications, subject to the practical ability to ship to the destination country and the address provided.

The cost of international shipping will be calculated separately and is not included in the price of the book or publication.

International shipments are made through postal services or third-party shipping providers. After the package has been delivered to the shipping provider, its further handling is subject to the provider’s terms, the postal systems in the destination country, and the instructions of local authorities.

The recipient is responsible for paying any customs duties, import taxes, clearance fees, levies, and other local charges that may apply in the destination country. These amounts are not included in the price of the book or in the shipping fees paid to Eretz Hemdah.

Eretz Hemdah does not guarantee that shipping will be available to every country or address. If, after an order is placed, it becomes apparent that shipping cannot be completed on reasonable terms, Eretz Hemdah will contact the customer to consider an alternative shipping method, a change of address, an additional payment, or cancellation of the order and a refund, as applicable.

Eretz Hemdah is not responsible for delays, customs hold, refusal by the authorities to admit the package into the destination country, or loss or damage occurring after the package has been delivered to the shipping provider, except for liability that cannot be excluded under applicable law.

7.6 Order Inquiries and Issues

In the event of an error in the order details, a shipping problem, a defective product, receipt of a product different from the one ordered, or an inquiry concerning a purchase, the customer may contact [email protected] and include the order details needed to locate it.

The customer is requested to contact Eretz Hemdah as soon as possible after discovering the issue so that Eretz Hemdah can examine and address it.

7.7 Cancellation of a Purchase

A request to cancel a purchase may be submitted by email to [email protected], by telephone at +972-2-5371485, and through any additional online method made available on the website, where required by law.

The request should state the customer’s name, contact details, and sufficient information to identify the order.

The right of cancellation, the applicable time limits, return of the product, costs, and refund of payment will be governed by applicable law and the circumstances of the transaction.

8. Permitted Use of the Website

The website is intended solely for personal, reasonable, and lawful use.

The website may not be used for any of the following purposes:

• disrupting the operation of the website or attempting to gain unauthorized access to its systems;

Unless expressly stated otherwise, Eretz Hemdah does not operate the external websites and services and does not control their content, availability, terms, or privacy policies.

Use of an external website or service is subject to the terms and policies of the entity operating it.

Personal information submitted through the website will be used in accordance with the website Privacy Policy and applicable law.

When a user uses a form, donation system, payment system, or third-party service, the information may also be provided to the entity operating that service, in accordance with the information presented to the user and the relevant privacy policy.

Eretz Hemdah works to maintain the proper operation and availability of the website but does not guarantee that the website will operate at all times without interruptions, malfunctions, disruptions, or outages.

These Terms of Use and use of the website will be governed by the laws of the State of Israel.

15. Information Submitted Through the Website

When submitting information through the website, the user must provide information that is as accurate, correct, and complete as possible.
